We're transparent about what we collect, why we collect it, and what you can ask us to do with it. This policy governs any personal or sensitive data collected through the Climes platform.

This Privacy Policy sets out how we collect, use, process, disclose and protect any information obtained from you through our platform — including the Climes website, the Carbon-OS product, the Climes API, and all associated products and services (together, the "Platform"). Capitalized terms not defined here have the meaning given in our Terms of Service.

"Personal Data" means any information that relates to a natural person through which an individual is identified — name, contact details, email address, gender, age, organisation name, organisation email, demographic information, photo identity, or any other information relevant to product choice and preferences you provide, including information gathered through use of the services.
"Technical Information" means information gathered through technologies such as cookies, web beacons, or similar, which automatically record information from your device. This may include IP address, device or browser type, ISP, referring or exit pages, clickstream data, operating system, hardware model, unique device identifiers, and mobile network. It also includes usage information and user statistics.
"Locational Information" means information obtained through GPS or other means, such as your geographical location.
"Social Media Data" — if you access the Platform through a third-party platform such as a social media service, or connect our services to one, the information we collect may include your username on that platform, any information or content the platform is entitled to share with us (such as profile picture, email address, friends list), and anything you have made public in connection with that platform. When you access the Platform through a third-party platform, you authorise us to collect, store, use and retain such information from that platform in accordance with this policy.
"Non-Personal Information" means any information that does not reveal your specific identity — browser information, cookies (as defined below), pixel tags, demographic information in aggregate, and similar. As with most websites, we gather some information automatically when you visit the Platform.
Sensitive Personal Data, Technical Information, Locational Information and Non-Personal Information are collectively referred to as "Information".

We collect, use, store and process your Information for any purpose permissible under applicable law (including where the law provides for such use in accordance with your consent). This includes:
Business or research purposes. Information (other than Sensitive Personal Information) is also used for business or research — improving and customising the Platform, and the products and services offered. We may archive this information for future updates and surveys.
Aggregated / anonymised data. We may aggregate and analyse Information to improve our services — average number of users, feature usage, response rate, and similar statistics regarding groups or individuals. We will not disclose any Sensitive Personal Information in this process.
These are collectively referred to as "Legitimate Purposes".
We do not disclose or share Information we collect from you with third parties, except to provide you with the services. Any disclosure is made in accordance with this policy, the procedure prescribed by law, and in compliance with our legal obligations. We may share your Information in the following circumstances:
Merger or acquisition. We may share Information upon the merger or acquisition of the Company with another company, and shall transmit and transfer the Information as part of the transaction.
With our service providers. We may share Information with service providers on a need-to-know basis, subject to obligations of confidentiality, for the provision of the services. We work with institutions, vendors, partners, advertisers, and other service providers — including those who provide contact information verification, website hosting, data analysis, infrastructure, information technology, auditing, and similar — under lawful contracts.
Employees and agents. We follow a strict confidentiality policy with regard to disclosure of confidential information to our employees or other personnel; disclosure is only on a need-to-know basis. Any breach is dealt with stringently.
Except as described in this section, we share Information only if you authorise us to.
Our Platform may provide links to other sites for your convenience. These sites have their own terms of use and privacy policies — check them before you submit any information there. We do not guarantee the content or security of those sites, and we are not responsible for their availability.
We may have certain features on our Platform that are hosted by third parties; your interaction with those features is governed by the privacy policy of those third parties.
We shall not be responsible for any loss, damage, claim or expense caused as a result of you accessing these third-party sites and features. We may use your Information to send you promotional information about third parties which we think you may find interesting, if you tell us that you wish this to happen. We shall not be responsible for any disclosure of Information due to unauthorised third-party access or other acts of third parties beyond our reasonable control.
Payment gateways. We use support services of third-party platforms to direct you to payment gateways when you pay for our services. Your financial information is collected, stored and retained by such third-party platforms. Please check and consent to the privacy policy of such third-party platforms to understand how they handle your information.
Our services are not meant to be used by children (as defined by applicable privacy laws for a particular jurisdiction). We do not knowingly collect Personal Information relating to children. If you believe your child has provided this information on our Platform, please contact us immediately and we will take reasonable steps to promptly remove or destroy it.
Subject to any exemptions provided by applicable laws, you have the following rights:
You can access, edit, modify and update your Personal Information by logging into your user profile, or by writing to us if you wish to exercise this right.
Our services and related documentation on our Platform give you the ability to access, update and delete certain Personal Information from your account. We will tell you whether we hold any of your Personal Information upon request, and will respond within a reasonable timeframe. Please note that we may retain certain information for record-keeping, to complete our services and related obligations, or to comply with legal obligations.
You have the right to object to our processing of your Personal Information, and/or to request that we restrict the processing of your Personal Information.
You have the right to request that we transfer your Personal Information to another controller, or directly to you, in a structured, commonly-used, machine-readable format. To exercise these rights, contact us at support@climes.io.
Your Information will primarily be stored in electronic form; certain data can also be stored in physical form. We may store, collect, process and use your data in countries other than the jurisdiction where it was collected, in compliance with applicable laws. We may enter into agreements with third parties to store or process your information. These third parties may have their own security standards; we will, on a commercially reasonable basis, require them to adopt reasonable security standards.
Our Platform may utilise "cookies" and other Technical Information. Cookies are small text files consisting of alphanumeric characters used to collect information about Platform activity, and to help us analyse web traffic and customise the Platform to your preferences. Cookies in no way give us access to your computer or mobile device. You can deny access to the installation of cookies by modifying your browser settings, however this may prevent you from taking full advantage of the Platform. Our use of cookies allows us to improve the Platform and your experience of it. We may also analyse Technical Information that does not contain Sensitive Personal Information for trends and statistics.
We retain your Information for as long as your account is active or as needed to provide our services. We retain and use the Information collected as necessary to comply with our legal obligations, resolve disputes, or for other Legitimate Purposes. If you cancel, deactivate, or unsubscribe your account, we are not under any obligation to retain your Information. However, we may retain the Information for the maximum period permitted under the applicable law from the date of deactivation.
You agree and accept that your Information may be stored in third-party cloud service infrastructure. While all reasonable attempts have been taken from our end to ensure safe and secure storage of your data, we shall not be liable for any data breach on the part of the third-party cloud provider that was beyond our control. In addition to the security measures put in place by the third-party cloud provider, we use physical, managerial, technical and operational safeguards as per industry standards and established best practices to protect the Information we collect. We use reasonable security practices and secure servers as mandated under applicable laws. We review our Information collection, storage, and processing practices, including physical security measures, to guard against unauthorised access.
As effective as these measures are, no security system is impenetrable. We cannot guarantee the security of our database, nor that the Information you supply will not be intercepted while being transmitted to us over the internet. Please note that emails and other communications you send to us through our Platform are not encrypted, and we strongly advise not communicating confidential information through these means.
Do Not Sell. We do not sell your Personal Data in the conventional sense (i.e., for money). However, like many companies, we use services that collect information from you (to deliver advertisements to you for example) and this may classify as a "sale" of your Personal Data. You can request to opt-out of this "sale" by writing to support@climes.io with the subject line "Sale of Information — Opt-out" and including your name, street address, city, state, and ZIP code. We are not responsible for notices that are not labelled or sent properly, or that do not have complete information.
Do Not Track. Our service currently does not respond to "Do Not Track" (DNT) signals and operates as described in this policy whether or not a DNT signal is received. To learn more about Do Not Track, visit allaboutdnt.com.
We may change our data privacy practices and update this policy as the need arises, and the same will be made available on the Platform. Our commitment to protecting your privacy will continue. We suggest you regularly check this policy for updates. Your continued use of the Platform or provision of Information after any update will imply your unconditional acceptance of it. We retain the right at any time to deny or suspend access to all or any part of the service to anyone we reasonably believe has violated any provision of this policy.
For Indian users, in furtherance of the Information Technology Act, 2000 ("IT Act") and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("Intermediary Guidelines"), a grievance officer is appointed to ensure compliance with the IT Act and the Intermediary Guidelines.

The grievance officer will revert to every complaint within 24 hours of receipt, and the Company will take best-effort steps to redress the complaint within 15 days of receipt.
